Freedom of religion is guaranteed by the Nigerian Constitution, which permits and upholds Islamic weddings and legislation. Islamic law applies to those who follow the religion and recognize it as their code of conduct. It is founded on the principles of Islam. Islamic family law addresses matters including marriage, the responsibilities and rights that follow from it, ending a marriage, and other things.

Islamic marriage law is not codified, as customary marriage law is not compiled and contained in a document. Islamic law governs marriage matters through Sharia rules that are drawn from the Quran and Hadith, Nigerian customs, and legal precedents. Islamic law generally adopts the jurisprudence of the Maliki School of law, sometimes referred to as fiqh, when it comes to marriage-related matters. the marriage’s dissolution as well as any other problems resulting from it

What Constitutes a Legal Islamic Matrimony in Nigeria? An Islamic marriage is legally consummated when the prospective husband proposes to the prospective wife. Another essential element of a lawful Islamic marriage is the approval of the bride’s parents or legal guardian. Following the necessary consent being granted, the families must decide on an appropriate dowry that should be given from the groom’s family to the bride’s family before a marriage ceremony may take place.

How to Get Married in Islam

•  A legitimate marriage proposal must exist. The man who wants to get married needs to let the woman know exactly what he wants out of a marriage.

• There needs to be a clear acceptance. The “wife-to- be” must consent to marry the person asking for her hand in marriage
• If the woman has never been married, she must also obtain her father’s or guardian’s permission before getting married
• The man wishing to get married must give the bride a dowry or marital gift after obtaining the necessary approvals. The family of each partner in the marriage must agree on the amount of the dowry, and there is no set amount.
