To end the contract, review the contract, talk to your agent first, request a formal termination in writing, sign a termination form, settle any financial obligations, contact the broker if needed, and consider legal help as a last resort.
Review the listing agreement (for sellers) or buyer representation agreement (for buyers) and pay attention to the termination clause, duration, and conditions. If you’re a seller, try to resolve the issue directly by explaining why you’re dissatisfied, what you’d like to change or improve, and that you’re considering ending the relationship if it can’t be resolved. Many agents will release you voluntarily if it’s not working out.
If you decide to cancel, write a formal request, including your name and property address, a statement requesting to terminate the agreement, the desired termination date, and a request for confirmation in writing. Signing a termination form releases both parties legally, and make sure all terms are clearly stated and kept for your records.
If your agent refuses to release you and you’re still under contract, escalate to the broker, who may be more flexible and may reassign you to another agent or let you go. If you believe the agent breached the contract or won’t release you without cause, consider speaking to a real estate attorney.
