The group cited a legal reply filed on July 14, 2025, by Chief Kanu Agabi, SAN, in response to the Federal Government’s rejection of a no-case submission submitted by Kanu’s defense team, in a statement issued by IPOB’s Media and Publicity Secretary, Comrade Emma Powerful.
IPOB called the submission a “significant legal development,” saying the defense’s claims are based on constitutional and evidentiary grounds and that the government hasn’t produced enough proof to move on with the case.
In the defense filing, the group emphasized a number of key points: Unresolved Legal Issues: IPOB pointed out that the prosecution’s response did not address any of the defense’s points, such as the lack of forensic authentication, the character of witness testimony, and the absence of direct victims. According to the organization, the argument is weakened by these omissions.
Unreliable Audio Evidence: According to the statement, the prosecution mostly uses modified audio recordings that the defense said were not independently checked. According to IPOB, this calls into question the material’s admissibility.
The accusation of Kanu importing a transmitter is one of the allegations, however according to IPOB, no supporting documentation or evidence has been provided.
Burden of Proof: In its defense, the defense reaffirmed the constitutional presumption of innocence until proven guilty and the prosecution’s burden of proof.
Technical Legal Issues: IPOB also asserted that certain charges might be invalid due to procedural or legal flaws.
The organization encouraged Justice Omotosho, who is presiding over the dispute, to evaluate the arguments given and deliver a verdict in accordance with the law.
According to the statement, “we think this case presents an opportunity to affirm the integrity of the judiciary and the principles of justice.”
Additionally, IPOB urged international observers, representatives of the media, and civil society to carefully review the court documents and monitor the proceedings.
Mazi Nnamdi Kanu, who has been detained since 2021, is accused of inciting others and broadcasting illegally, among other offenses. He has entered a not guilty plea to every accusation.
